Terms of Service
The agreement for using Care Daily, including our apps, devices and services. It also serves as the license for our software. Written to be read, not skimmed past.

People Power Company d/b/a Care Daily is a Delaware corporation based in Kirkland, Washington.
Important at a glance
Care Daily is not a 911 service, emergency dispatch service, medical device, or healthcare provider. It can help surface patterns, alerts, and insights, but it does not guarantee that an event will be detected, reported, or prevented or that emergency services will be contacted or will respond. Power, internet, mobile service, device placement, and third-party systems can all affect performance. You must not rely on Care Daily as the only way to monitor someone or to know about or respond to an emergency.

1. Overview and acceptance
These Terms of Service govern your access to and use of Care Daily websites, mobile applications, device firmware, cloud services, alerts, reports, communications features, software development kits (SDKs), and compatible connected-device experiences that we make available to consumers, families, caregivers, and other authorized users.
When we say "Care Daily," "we," "us," or "our," we mean People Power Company d/b/a Care Daily. When we say "you" or "your," we mean the person or organization using the service. If you use the service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
These Terms also act as the end user license agreement for any Care Daily apps, firmware, and SDKs. By installing, accessing, or using our apps, firmware, or SDKs, you agree to this license and to these Terms.
If you see a different brand or logo when you use the service, a partner may be offering Care Daily technology under its own brand. That partner may have its own terms with you. Those partner terms do not replace these Terms for our underlying service unless a separate written agreement with us says so.
If you use Care Daily through a business, health plan, provider, employer, senior community, or other organization that has its own written agreement with us, that agreement governs our relationship with that organization. These Terms still apply to your personal use of our apps and sites to the extent they do not conflict with that separate agreement.
By creating an account, clicking to accept, buying a subscription, installing or using our apps or firmware, using our SDKs, using a device or integration with the service, or otherwise accessing the service, you agree to these Terms and to our Privacy Policy at caredaily.ai/privacy. If you do not agree, do not use the service.
Your acceptance may be captured through our apps, our websites, a partner app or site that uses our software, an online checkout flow, or an electronic signature. We keep a record of when and how you accepted, such as the date, time, version of the Terms, and the app, site, or device you used.
2. Eligibility and who may use the service
You must be at least 18 years old and legally able to enter into a binding agreement to open an account. Accounts for minors may only be created and managed by a parent, legal guardian, or other adult who has legal authority to do so. Minors may only use the service under adult supervision.
If you are creating or managing an account for another adult, you are responsible for having any permissions, notices, and consents required by law or by your relationship with that person.
If you set up monitoring or data collection in a home or other location for someone who does not have their own account, including an older adult, other household members, caregivers, employees, roommates, or regular visitors, you are responsible for:
- Explaining in a clear way what devices are present and what they do.
- Getting any notices, permissions, or consents that the law where you live requires.
- Making sure that monitoring is appropriate for your relationship with that person.
By turning on monitoring, you confirm that you have authority to share information about people in that location with us and with any invited users.
You may not use the service if doing so would violate applicable law, sanctions, export controls, or restrictions imposed by a regulator, court, or governmental authority.
3. What the service does and does not do
Care Daily is designed to help users and invited care-circle members stay informed through connected devices, data processing, alerts, reports, messaging, and AI-assisted insights related to activity, wellness, safety, home conditions, and connected services.
The service is not fail-safe and is not appropriate where failure could reasonably be expected to cause death, serious bodily injury, or severe property or environmental harm. The service is not intended for nuclear facilities, aviation, mass transit while in motion, life-support systems, Class III medical devices, or other high-risk uses.
Care Daily is not a medical device, personal emergency response system, 911 service, emergency dispatch service, or healthcare provider. It does not diagnose, treat, cure, or prevent any disease or condition.
The service is not a substitute for in-person supervision, emergency response, clinical judgment, diagnosis, treatment, medication management, or professional caregiving. You should call 911 or local emergency services for emergencies.
Any optional escalation, call center, or emergency-notification features are offered on a commercially reasonable efforts basis only. They are not certified or intended to contact a 911 public safety answering point or other emergency service on your behalf. You must maintain other independent methods to receive emergency alerts and to contact emergency services.
You are responsible for keeping other safety measures in place, such as phones, smoke detectors, security systems, and medical devices. You must not rely on Care Daily as the only safeguard for any person or property.
- Alerts may be delayed, incomplete, inaccurate, or not delivered at all.
- Events can be missed because of placement, power loss, internet or cellular outages, battery depletion, device limitations, environmental conditions, user error, software bugs, misconfiguration, or third-party failures.
- An alert, escalation, or call does not guarantee that emergency services will be contacted, will receive accurate information, or will respond in time.
- Any trends, scores, summaries, AI outputs, or recommendations are informational tools only and should be evaluated by the people responsible for the individual, property, or situation.
4. Accounts, locations, and invited users
You must provide accurate information and keep it current. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.
A "location" means a home, room, apartment, or other physical place associated with the service. You may invite family members, household members, caregivers, or other trusted users to access a location. Those invited users may receive content, alerts, activity information, or other information that you choose to share or enable for sharing.
You are responsible for deciding who has access, what permissions they receive, and for removing access when it is no longer appropriate. If you share access to someone else's information, you represent that you have the right to do so.
If laws where you live require posted notices or consent from people who enter or occupy a monitored location, you are responsible for meeting those requirements, for example by posting a simple notice that monitoring is in use.
We are not responsible for what invited users do with information you share with them.
Account security
- Use a strong password and protect your devices and login credentials.
- Notify us promptly if you believe your account has been compromised.
- We may require identity verification before processing certain account changes or privacy requests.
5. Devices, third-party services, and installation
The service may work with Care Daily devices and with third-party devices, communications services, monitoring providers, voice assistants, platforms, and integrations. Third-party products and services are provided under their own terms and privacy policies, and we are not responsible for their acts, omissions, outages, or security practices.
You are responsible for obtaining and maintaining all required electricity, internet access, mobile service, networking equipment, smart devices, batteries, mounting materials, permits, and any other items needed to use the service.
If we or a partner provide onboarding, installation, or remote setup guidance, that assistance is provided as a convenience. You remain responsible for final placement, testing, and ongoing suitability of devices for your home or use case, and for checking that devices, alerts, and automations perform as you expect.
Some sensors and devices may capture information about anyone in the monitored space, including people who are not account holders. By installing and using those devices, you confirm that you have authority to do so and have provided any required notices or consents.
Leased hardware
Some plans include hardware that we lease to you, not sell to you. Unless your order says otherwise:
- Leased hardware remains our property.
- You get a limited right to use it only with the service while your subscription is active.
- You agree to take reasonable care of leased hardware and to use it as described in our instructions.
- When your subscription ends or we ask you to replace hardware, you must return leased hardware within the time and using the method we specify.
We may charge a replacement fee up to the then-current retail value for leased hardware that is not returned, is lost, or is damaged beyond normal wear and tear, as allowed by law and as described at or before checkout or in your order.
6. Subscriptions, billing, and auto-renewal
Some features require a paid plan. Prices, plan details, minimum terms, and what is included will be shown at checkout, in your order, or in a separate written agreement.
Unless a separate written agreement says otherwise, subscriptions begin when activated and continue for the billing period you selected. Our standard direct-to-consumer subscription is currently 99 US dollars per month plus applicable taxes, unless we show a different price at checkout.
Unless you cancel before the next renewal date, your paid subscription may renew automatically for the same length of time, and you authorize us to charge the payment method on file for the then-current fees, taxes, and other applicable charges.
If you accepted a consumer subscription online, you may cancel at any time through the online cancellation path we make available in your account or service interface or, if no self-service cancellation path is available, by emailing support@caredaily.ai from the email address associated with your account. To avoid being charged for the next month, you must cancel before the start of that renewal period.
Except for the 30-day money-back guarantee described below and any other refund terms we show you at purchase or that are required by law, fees are non-refundable. If a plan includes subsidized hardware or bundled equipment from us or a partner, additional minimum-term, early termination, non-return, or damage charges may apply as described at purchase or in your order.
30-day consumer money-back guarantee
If you are a new direct consumer subscriber and you cancel your subscription within 30 days after first activation:
- We will refund the first monthly subscription fee you paid to us for that subscription.
- We will process the refund once you return any leased hardware we supplied for that subscription in good working condition, ordinary wear and tear excepted, within the return period and using the method we specify.
- This guarantee applies only to direct consumer subscriptions purchased from Care Daily, not to subscriptions or equipment you obtain from a third-party provider such as a health plan, reseller, or housing provider.
This guarantee is a money-back guarantee, not a free trial. Your subscription starts when activated, and fees are charged unless and until you cancel within the first 30 days and return leased hardware as required.
Auto-renewal disclosures and notices
At or before checkout for an auto-renewing subscription, we will clearly describe the price, renewal schedule, and how to cancel. After you sign up, we will send you a confirmation email that describes your auto-renewing subscription, the renewal schedule, the recurring charges, and how to cancel.
Where a state auto-renewal law requires it, we will also send you a reminder notice before your subscription renews with information about the renewal term, price, and how to cancel online.
Other billing terms
- You are responsible for all taxes, duties, telecom charges, SMS charges, data charges, permits, and emergency-response fees associated with your use of the service.
- If your payment method fails, we may suspend paid features, retry payment, or require a different payment method.
- We may change pricing, package structure, or feature availability for a future renewal term by posting updated pricing or presenting it at renewal or purchase. Where applicable law requires advance notice, an acknowledgment, an online cancellation method, or separate notice of a material change to an automatically renewing or continuous-service offer, we will provide that process for the affected subscription.
- If you receive Care Daily through a third-party organization, that organization may set its own prices, billing terms, and refund rules. Their terms control those charges.
7. Your content and service data
As between you and Care Daily, you retain ownership of the content you submit to the service and, subject to applicable law and third-party rights, the data generated from your connected devices and locations.
To operate the service, you grant us and our service providers a worldwide, non-exclusive, royalty-free license to host, copy, process, transmit, analyze, display, and use that content and data as necessary to provide, secure, support, improve, and personalize the service.
This includes:
- Operating the apps, devices, and cloud services you use.
- Generating alerts, summaries, reports, and insights you request or that are part of your plan.
- Training, testing, and improving algorithms and AI models that power the service.
- Backing up systems and maintaining logs for security and reliability.
You also authorize us to use de-identified, anonymized, or aggregated data that no longer reasonably identifies you for analytics, product improvement, benchmarking, safety, research, and business operations.
You are responsible for the legality of the content and data you upload, record, transmit, or share, and for obtaining permissions from anyone whose information, image, voice, likeness, or device data you share through the service.
Storage and retention limits
We may set or change limits on storage, message size, recording duration, retention windows, bandwidth, or feature access. Older or excess content may be deleted, summarized, hidden behind storage limits, or otherwise made unavailable according to the applicable plan or service design. Our Privacy Policy describes how long we keep different types of information.
8. AI features, alerts, and recommendations
Some Care Daily features use automated models, rules, machine learning, or generative AI to analyze data and to produce summaries, risk indicators, anomaly detection, or recommended next steps.
These outputs are probabilistic, can be wrong, and may reflect incomplete, outdated, or biased information. We do not guarantee that any AI-generated output is correct, complete, or appropriate for your situation.
You are responsible for human review of important decisions. Do not rely on AI-generated output as the sole basis for medical, caregiving, legal, emergency, insurance, housing, employment, or financial decisions.
- An alert or insight does not guarantee that an incident occurred.
- No alert does not guarantee that an incident did not occur.
- Care Daily does not promise any particular clinical, safety, security, or financial outcome.
Our AI systems do not, by themselves, make binding decisions about eligibility for or pricing of insurance coverage, healthcare coverage, housing, or similar legal rights without meaningful human involvement. If any such decisions are made, they are made by your insurer, provider, employer, housing provider, or another organization using its own rules and review processes.
We may use information from your use of AI features, including de-identified or aggregated data where possible, to train and improve models that power the service. Our Privacy Policy explains how we handle this information and how we work with third-party AI providers.
9. Acceptable use
You may use the service only for lawful purposes and only in ways that comply with these Terms and the rights of others.
You agree not to:
- Interfere with, disrupt, reverse engineer, scrape, probe, or test the security of the service except as permitted by law and with our prior written permission where required.
- Use the service to stalk, harass, exploit, impersonate, defame, invade privacy, or violate intellectual-property or publicity rights.
- Upload malicious code, spam, illegal content, sexually explicit content involving minors, or content that is fraudulent, threatening, or abusive.
- Use the service in a way that creates unreasonable load, bypasses access controls, or attempts to access non-public systems or data.
- Resell, sublicense, or provide the service to third parties on a service-bureau basis unless we have expressly authorized it in writing.
10. Intellectual property and software license
The service, including our software, models, firmware, SDKs, interfaces, documentation, trademarks, logos, and related technology, is owned by Care Daily or its licensors and is protected by intellectual-property and other laws. Except for the limited rights expressly granted in these Terms, no rights are transferred to you.
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to:
- Install and use our mobile apps on devices you own or control.
- Use device firmware we provide, solely on the devices with which it came.
- Use any SDKs or developer tools we make available to you, solely to build and support integrations that are authorized by us.
You may use this license only to access the service for your own household or, if authorized, your organization. You may not copy, modify, distribute, sell, or create derivative works of the apps, firmware, or SDKs, except as allowed by law or by a separate written agreement with us.
If you provide feedback or suggestions about the service, you agree that we may use that feedback without restriction or compensation to you.
11. Privacy and communications
Our Privacy Policy at caredaily.ai/privacy explains how we collect, use, disclose, and protect personal information, including information about people who are monitored in a location but do not have their own account and visitors who may be captured by sensors. That policy includes notices for California residents and for Washington consumer health data.
Some of the information we process from in-home devices and inferences, such as patterns of movement, sleep, bathroom use, or falls, may be treated as consumer health data or sensitive personal information under certain laws. Our Privacy Policy explains how we seek any additional consents or authorizations that those laws require and how people can exercise their rights.
By using the service, you acknowledge that we may process personal information as described in the Privacy Policy and that you have obtained any permissions required to share information about others.
You agree that we may send you service-related communications, including onboarding messages, security notices, billing notices, feature notices, and other operational communications by email, push notification, app message, phone, or SMS, as allowed by law. Where required, we will ask for your consent before sending marketing communications. You can opt out of marketing communications, but we may still send service or legal notices.
12. Suspension, cancellation, and termination
You may stop using the service at any time. If you have a paid subscription, cancellation will usually take effect at the end of the current paid term unless the applicable plan or law says otherwise.
We may suspend or terminate some or all of the service, or your access to it, without liability if we believe:
- You violated these Terms.
- You created risk, legal exposure, or security concerns for us, users, or others.
- Your payment is overdue.
- A device, integration, or third-party provider is causing technical or legal issues.
- We are required to do so by law, a regulator, or a court.
- Continuing service is no longer commercially, technically, or operationally practical.
Termination does not relieve you of amounts already owed. It also does not relieve you of your obligations to return leased hardware and to pay any lawful replacement or non-return fees, as described in section 5 and in your order or checkout terms.
Sections that by their nature should survive termination will survive, including sections on fees owed, leased hardware, intellectual property, disclaimers, limitations of liability, dispute resolution, and general legal terms.
13. Service changes and availability
We may modify, suspend, or discontinue any part of the service at any time. Features may change, improve, be renamed, be limited, or be retired. We are not obligated to continue any particular feature, integration, device compatibility, pricing model, or roadmap item.
We may update these Terms from time to time by posting a revised version through our website, app, or service interface. The updated version becomes effective when posted unless a later effective date is stated. It is your responsibility to review the current Terms periodically. Continued use of the service after updated Terms are posted means you accept the updated Terms.
If applicable law requires us to give you separate notice, an opportunity to cancel, or obtain consent before a particular change takes effect, we will do so for that change. For auto-renewing subscriptions, we will follow any notice or acknowledgment rules that apply in your state.
Service availability may be affected by maintenance, outages, capacity limits, acts of nature, or failures of electricity, internet, mobile networks, devices, or third-party services. We do not guarantee continuous or error-free operation.
14. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."
CARE DAILY DISCLAIMS ALL EXPRESS, IMPLIED, STATUTORY, AND OTHER WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, ACCURACY, AND SYSTEM INTEGRATION.
Without limiting the above:
- We do not guarantee that the service will be uninterrupted, timely, secure, accurate, complete, or error-free, or that defects will be corrected.
- We do not guarantee that alerts, communications, recordings, or data will be transmitted, stored, or available at any particular time.
- We do not guarantee any improvement in health, safety, independence, or financial outcomes.
- Care Daily is not a medical device, medical service, or certified emergency response system.
No oral or written information or advice from Care Daily or its representatives creates any warranty unless expressly stated in a signed written agreement.
15. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARE DAILY AND ITS AFFILIATES, LICENSORS, SUPPLIERS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, USE, DATA, BUSINESS INTERRUPTION, OR PROPERTY DAMAGE, EVEN IF ADVISED OF THE POSSIBILITY OF THOSE DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF CARE DAILY AND ITS AFFILIATES, LICENSORS, SUPPLIERS, AND SERVICE PROVIDERS FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF:
- THE AMOUNT YOU PAID TO CARE DAILY FOR THE APPLICABLE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR
- USD 100.
Nothing in these Terms limits liability that cannot be limited under applicable law.
16. Indemnification
To the extent permitted by law, you will defend, indemnify, and hold harmless Care Daily and its affiliates, officers, directors, employees, contractors, licensors, suppliers, and agents from and against claims, losses, liabilities, damages, judgments, penalties, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:
- Your use of the service.
- Your content or data.
- Your breach of these Terms.
- Your violation of law or the rights of another person.
17. Dispute resolution and arbitration
Please read this section carefully. It affects your legal rights.
Before filing a claim, you and Care Daily agree to try to resolve the dispute informally by written notice describing the issue and the requested resolution. If we cannot resolve the dispute informally within 30 days, either party may pursue the claim as described below.
Except for claims that qualify for small claims court, claims for injunctive relief, or claims relating to intellectual property or misuse of the service, any dispute, claim, or controversy arising out of or relating to these Terms or the service will be resolved by binding individual arbitration administered by the American Arbitration Association under its applicable consumer or commercial rules. The arbitration will take place in English and before a single arbitrator. Judgment on the award may be entered in any court of competent jurisdiction.
- No class actions, class arbitration, representative actions, or private attorney general actions are allowed to the maximum extent permitted by law.
- Each side waives any right to a jury trial for claims that proceed in court.
- You may opt out of arbitration within 30 days after first accepting these Terms by sending written notice to support@caredaily.ai with your name, account email, and a clear statement that you want to opt out of arbitration.
Some countries or states do not allow mandatory arbitration or certain waivers. In those places, this section applies only to the extent allowed by law.
18. General terms
These Terms, together with our Privacy Policy and any additional terms presented for a particular feature, plan, or service, form the entire agreement between you and Care Daily regarding the consumer-facing service addressed by these Terms and replace prior written or oral discussions about that subject.
If any part of these Terms is found unenforceable, the remaining parts will remain in effect to the fullest extent allowed by law. Our failure to enforce a provision is not a waiver.
You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, financing, reorganization, sale of assets, or by operation of law.
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-laws rules, except to the extent federal law or the arbitration provisions above control. For claims that may be brought in court, exclusive venue will be in the state or federal courts located in King County, Washington, unless applicable law requires otherwise.
